AEW Star Jeff Hardy Pleads No Contest To Multiple Charges In DUI Case

The D.U.I. case against Jeff Hardy is closed after the AEW star entered pleas on multiple charges in Volusia County, Florida court on Thursday.

Hardy pleaded "nolo contendere" to three counts, declining to contest the charges in court. Officially, the judge in the case adjudicated Hardy guilty on all counts, including the most serious one: a felony charge of driving under the influence of drugs or alcohol. It's Hardy's third such offense in the State of Florida within the last few years. Hardy was sentenced to serve 38 days in prison. He was credited with time already served, instantly completing his sentence.

The charges stemmed from Hardy's arrest on June 13, 2022. Florida Highway Patrol pulled over Hardy after his vehicle was spotted driving erratically. Authorities said Hardy's blood-alcohol level was found to be three times the legal limit.

On Tuesday, Hardy's lawyer filed a motion to suppress breath test results, arguing they were unreliable. Specifically, the motion stated that the Intoxilyzer unit used to test Hardy's breath during his arrest "exhibited significant signs of unreliability both during inspections and subject breath tests, yet it was not repaired or removed from evidentiary use." The motion added that the Intoxilyzer unit had not been inspected in May 2022, the month prior to Hardy's arrest.

Evidence attached to the motion included the record of the breath test administered to Hardy, which police are required to perform twice within a fifteen-minute period for it to be considered an "approved test." The record shows that Hardy's first sample returned a 0.313 blood-alcohol level. However, the record shows a second attempt to administer the breath test failed.

AEW owner Tony Khan suspended Hardy following his arrest and insisted Hardy enter rehab, which Hardy reportedly did last summer.
